1. Definities
LMC / Wij: Langhoor Marchal Consultancy, gevestigd te Maastricht, Nederland, KvK 88375692, handelend onder de naam MySecretCrush.
Platform: De online datingapplicatie MySecretCrush, inclusief de website mysecretcrush.app, de mobiele applicaties voor iOS en Android, en alle gerelateerde diensten.
Gebruiker / U: Elke natuurlijke persoon die een account aanmaakt of het platform gebruikt.
Diensten: Profielaanmaak, matchingalgoritmen, Baken Mode (BLE-gebaseerde nabijheidsdetectie), berichtenverkeer, premiumfuncties en abonnementen.
Baken Mode: De Bluetooth Low Energy-functionaliteit waarmee gebruikers gedurende maximaal 15 minuten vindbaar zijn voor andere gebruikers in de nabijheid.
Inhoud: Alle teksten, foto's, berichten en overige materialen die een gebruiker uploadt, deelt of publiceert via het platform.
2. Toepasselijkheid
Deze Algemene Voorwaarden zijn van toepassing op alle gebruikers van het MySecretCrush-platform. Door u te registreren of het platform te gebruiken, bevestigt u deze Voorwaarden te hebben gelezen en hiermee akkoord te gaan. Indien u niet akkoord gaat, dient u het platform niet te gebruiken. LMC behoudt zich het recht voor deze Voorwaarden te wijzigen. Wijzigingen worden via het platform of per e-mail gecommuniceerd.
3. Aard van de Dienst
MySecretCrush biedt een technologisch platform ter facilitering van contacten tussen gebruikers. Wij:
- verifiëren niet de identiteit van alle gebruikers
- voeren geen strafrechtelijke achtergrondcontroles uit
- bieden geen garantie voor compatibiliteit, intenties of gedrag van gebruikers
- fungeren uitsluitend als tussenpersoon in de technologische zin
4. Account, Leeftijd en Toegang
4.1 Minimumleeftijd
U dient minimaal 18 jaar oud te zijn om dit platform te gebruiken. Accounts van minderjarigen worden onmiddellijk verwijderd zodra wij hiervan op de hoogte worden gesteld.
4.2 Accountregistratie
Gebruikers dienen nauwkeurige informatie te verstrekken, een geldig e-mailadres op te geven en eerlijke profielinformatie in te voeren.
4.3 Accountbeveiliging
U bent verantwoordelijk voor het vertrouwelijk houden van uw inloggegevens en alle activiteiten via uw account. Bij vermoeden van ongeoorloofde toegang dient u ons onmiddellijk te informeren via info@mysecretcrush.app.
4.4 Accounteigendom
Accounts zijn persoonlijk, niet-overdraagbaar en mogen niet worden gedeeld met anderen.
5. Gebruikersprofielen en Inhoud
Gebruikers mogen foto's, profielbeschrijvingen, interesses, voorkeuren en andere persoonlijke informatie uploaden. Door inhoud te uploaden bevestigt u dat u eigenaar bent of het recht heeft deze te gebruiken. U verleent LMC een niet-exclusieve licentie om uw inhoud op het platform weer te geven. U blijft eigenaar van uw inhoud. LMC kan inhoud verwijderen die in strijd is met deze Voorwaarden of toepasselijke wetgeving.
6. Gebruikersgedrag en Acceptabel Gebruik
Gebruikers stemmen ermee in het platform niet te gebruiken voor:
- intimidatie, pesten of stalking
- haatdragende taal of discriminatie op basis van geslacht, ras, religie, nationaliteit, seksuele geaardheid of handicap
- seksuele uitbuiting of mensenhandel
- illegale activiteiten van welke aard dan ook
- identiteitsfraude of het zich voordoen als iemand anders
- delen van privé-informatie van anderen zonder toestemming
- spam, massale berichten of commerciële werving
- financiële fraude of oplichtingspraktijken
- uploaden van illegale inhoud, waaronder materiaal van seksueel misbruik van minderjarigen
- pogingen tot reverse-engineering, hacken of ondermijnen van de platformbeveiliging
Overtredingen kunnen leiden tot: onmiddellijke schorsing, permanente accountbeëindiging, melding bij de bevoegde autoriteiten.
7. Berichten en Interacties
Het platform maakt communicatie tussen gebruikers mogelijk. LMC controleert het gedrag van gebruikers niet proactief. Interacties vinden plaats op eigen risico. Wij kunnen communicatie monitoren uitsluitend voor veiligheids- en moderatiedoeleinden.
8. Offline Ontmoetingen en Persoonlijke Verantwoordelijkheid
LMC is niet aansprakelijk voor enige schade, incidenten, letsel, misdrijven of verliezen als gevolg van offline ontmoetingen tussen gebruikers. Gebruikers dienen gepaste veiligheidsmaatregelen te nemen, zoals: ontmoeten op openbare plaatsen, anderen informeren over uw verblijfplaats, gebruik van eigen vervoer.
9. Abonnementen en Facturering
Bepaalde functies vereisen een betaald abonnement. Abonnementen worden automatisch verlengd tenzij u deze annuleert vóór het einde van de factureringsperiode. U kunt uw abonnement op elk moment opzeggen via de instellingen van het platform of de app store.
Tarieven:
- Activeringskosten: €0,01 (eenmalig, ter verificatie van uw betaalmethode)
- Proefperiode: 14 dagen gratis
- Abonnementsprijs na proefperiode: €4,95 per maand
10. Betalingen
Betalingen worden verwerkt via Stripe Inc. LMC slaat geen volledige creditcardgegevens op. Alle transacties worden beveiligd verwerkt conform PCI-DSS normen.
11. Herroepingsrecht
Gezien de digitale aard van de dienst begint de toegang onmiddellijk na aankoop. Door te abonneren doet u afstand van het standaard herroepingsrecht van 14 dagen zodra de toegang is gestart, conform Art. 16 sub m van Richtlijn 2011/83/EU inzake consumentenrechten.
12. Veiligheidsrapportage en Moderatie
Gebruikers kunnen intimidatie, oplichting, nep-profielen en ongepaste inhoud melden via info@mysecretcrush.app of via de in-app meldingsfunctie. LMC behoudt zich het recht voor accounts te beoordelen, inhoud te verwijderen en gebruikers te schorsen.
13. Beschikbaarheid en Onderhoud
Wij streven ernaar het platform 24/7 beschikbaar te houden, maar ononderbroken toegang kan niet worden gegarandeerd. Gepland onderhoud wordt zo mogelijk vooraf aangekondigd. Er wordt geen compensatie verstrekt voor tijdelijke uitval.
14. Updates en Wijzigingen
Wij kunnen het platform op elk moment aanpassen. Gebruikers hebben geen recht op een specifieke versie of functionaliteit. Wij informeren gebruikers over wezenlijke wijzigingen.
15. Intellectueel Eigendom
Alle intellectuele eigendomsrechten met betrekking tot het platform — inclusief software, ontwerpen, logo's, teksten en databases — berusten bij Langhoor Marchal Consultancy. Gebruikers ontvangen een beperkte, niet-overdraagbare licentie om het platform te gebruiken overeenkomstig deze Voorwaarden.
16. Privacy en Gegevensverwerking
Persoonsgegevens worden verwerkt conform ons Privacybeleid, dat integraal onderdeel uitmaakt van deze Voorwaarden.
17. Aansprakelijkheidsbeperking
De totale aansprakelijkheid van LMC is beperkt tot het bedrag dat de gebruiker in de voorafgaande 12 maanden heeft betaald, met een maximum van €50. LMC is niet aansprakelijk voor indirecte schade, gevolgschade, gederfde winst of reputatieschade, noch voor schade door storingen van systemen van derden.
18. Gegevensbeveiliging
Langhoor Marchal Consultancy is niet aansprakelijk voor ongeoorloofde toegang door derden, datalekken veroorzaakt door derden, of schade als gevolg van cyberaanvallen, voor zover LMC aantoonbaar passende beveiligingsmaatregelen heeft getroffen.
19. Externe Integraties
LMC is niet verantwoordelijk voor storingen of fouten binnen systemen van derden, zoals hostingproviders, betalingsverwerkers of push-notificatiediensten.
20. Accountopschorting en Beëindiging
LMC kan accounts schorsen of beëindigen bij: overtredingen van deze Voorwaarden, frauduleus gedrag, niet-betaling van verschuldigde kosten, op verzoek van bevoegde autoriteiten. Bij beëindiging worden uw gegevens verwerkt conform het Privacybeleid.
21. Proefperiodes
Proefperiodes bieden tijdelijk gratis toegang en worden automatisch omgezet in betaalde abonnementen tenzij u deze annuleert vóór het einde van de proefperiode via de app store of platforminstellingen.
22. Betafuncties
Betafuncties worden aangeboden "zoals ze zijn". Ze kunnen zonder voorafgaande kennisgeving worden gewijzigd, kunnen fouten bevatten, en kunnen worden verwijderd of aangepast. LMC biedt geen garanties voor de werking van betafuncties.
23. Wijzigingen in deze Voorwaarden
Wij kunnen deze Voorwaarden periodiek wijzigen. Wezenlijke wijzigingen worden minimaal 30 dagen van tevoren gecommuniceerd via het platform of per e-mail. Voortgezet gebruik na wijziging geldt als acceptatie.
24. Toepasselijk Recht en Geschillen
Deze Voorwaarden worden beheerst door Nederlands recht. Geschillen worden voorgelegd aan de bevoegde rechter in de rechtbank Limburg, locatie Maastricht. EU-consumenten kunnen gebruik maken van het Online Dispute Resolution-platform: ec.europa.eu/consumers/odr

1. Definitions
LMC / We: Langhoor Marchal Consultancy, Maastricht, Netherlands, CoC 88375692, trading as MySecretCrush.
Platform: The MySecretCrush dating application, including mysecretcrush.app, iOS and Android mobile apps, and all related services.
User / You: Any natural person who creates an account or uses the platform.
Services: Profile creation, matching algorithms, Beacon Mode (BLE proximity detection), messaging, premium features, and subscriptions.
Beacon Mode: The Bluetooth Low Energy feature that makes users discoverable to nearby users for a maximum of 15 minutes.
Content: All text, photos, messages, and other materials a user uploads, shares, or publishes via the platform.
2. Applicability
These Terms apply to all users of MySecretCrush. By registering or using the platform, you confirm you have read and agree to these Terms. If you do not agree, do not use the platform. LMC reserves the right to modify these Terms, communicated via the platform or by email.
3. Nature of the Service
MySecretCrush provides a technology platform to facilitate introductions between users. We do not verify all users' identities, conduct criminal background checks, or guarantee compatibility, intentions, or behaviour of users. The platform acts solely as an intermediary technology service.
4. Account, Age and Access
4.1 Minimum Age
You must be at least 18 years old. Accounts belonging to minors are deleted immediately upon discovery.
4.2 Account Registration
Users must provide accurate information, a valid email address, and truthful profile information.
4.3 Account Security
You are responsible for maintaining the confidentiality of your credentials and all activities performed through your account. Report suspected unauthorised access immediately to info@mysecretcrush.app.
4.4 Account Ownership
Accounts are personal, non-transferable, and may not be shared.
5. User Profiles and Content
Users may upload photos, profile descriptions, interests, preferences, and personal information. By uploading content, you confirm you own it or have the right to use it. You grant LMC a non-exclusive licence to display your content on the platform. You retain ownership. LMC may remove content that violates these Terms or applicable law.
6. User Conduct and Acceptable Use
Users agree not to use the platform for:
- harassment, bullying, or stalking
- hate speech or discrimination based on gender, race, religion, nationality, sexual orientation, or disability
- sexual exploitation or human trafficking
- any illegal activities
- impersonation or identity fraud
- sharing others' private information without consent
- spam, mass messaging, or commercial solicitation
- financial fraud or scams
- uploading illegal content including CSAM
- attempting to reverse-engineer, hack, or undermine platform security
Violations may result in: immediate suspension, permanent account termination, reporting to authorities.
7. Messaging and Interactions
The platform enables communication between users. LMC does not proactively monitor user behaviour. Interactions occur at your own risk. We may monitor communications only for safety and moderation purposes.
8. Offline Meetings and Personal Responsibility
LMC is not liable for any damages, incidents, injuries, crimes, or losses resulting from offline meetings between users. Users should: meet in public places, inform others of their whereabouts, and use their own transport.
9. Subscriptions and Billing
Certain features require a paid subscription. Subscriptions auto-renew unless cancelled before the end of the billing period. You may cancel anytime via platform settings or your app store.

- Subscription after trial: €4.95/month
10. Payments
Payments are processed by Stripe Inc. LMC does not store full card details. All transactions are secured in accordance with PCI-DSS standards.
11. Right of Withdrawal
Due to the digital nature of the service, access begins immediately after purchase. By subscribing you waive the standard 14-day withdrawal right once access has started, in accordance with Art. 16(m) of EU Consumer Rights Directive 2011/83/EU.
12. Safety Reporting and Moderation
Users may report harassment, scams, fake profiles, and inappropriate content via info@mysecretcrush.app or the in-app reporting feature. LMC reserves the right to review accounts, remove content, and suspend users.
13. Availability and Maintenance
We aim for 24/7 availability but cannot guarantee uninterrupted access. Scheduled maintenance will be announced where possible. No compensation is provided for temporary downtime.
14. Updates and Changes
We may modify the platform at any time. Users have no right to a specific version or feature. We will inform users of material changes.
15. Intellectual Property
All intellectual property rights related to the platform — including software, designs, logos, text, and databases — belong to Langhoor Marchal Consultancy. Users receive a limited, non-transferable licence to use the platform in accordance with these Terms.
16. Privacy and Data Processing
Personal data is processed in accordance with our Privacy Policy, which forms an integral part of these Terms.
17. Liability Limitation
LMC's total liability is limited to amounts paid by the user in the previous 12 months, with a maximum of €50. LMC is not liable for indirect damages, consequential loss, lost profits, reputational damage, or failures within third-party systems.
18. Data Security
Langhoor Marchal Consultancy is not liable for unauthorised access by third parties, data breaches caused by third parties, or damages resulting from cyber attacks, provided LMC has implemented appropriate security measures.
19. External Integrations
LMC is not responsible for outages or failures within third-party systems such as hosting providers, payment processors, or push notification services.
20. Account Suspension and Termination
LMC may suspend or terminate accounts for: violations of these Terms, fraudulent behaviour, non-payment, or at the request of competent authorities. Upon termination, your data is processed in accordance with the Privacy Policy.
21. Trial Periods
Trial periods provide temporary free access and automatically convert to paid subscriptions unless cancelled before the trial ends via the app store or platform settings.
22. Beta Features
Beta features are provided "as is". They may change without notice, may contain bugs, and may be removed or altered. LMC provides no guarantees regarding beta feature performance.
23. Changes to These Terms
We may update these Terms periodically. Material changes will be communicated at least 30 days in advance via the platform or email. Continued use after changes constitutes acceptance.
24. Governing Law and Disputes
These Terms are governed by Dutch law. Disputes are submitted to the competent court in Limburg, Maastricht. EU consumers may use the Online Dispute Resolution platform: ec.europa.eu/consumers/odr
